After a jury convicted appellant of the misdemeanor offense of reckless driving under TEX. REV. CIV. STAT. ANN. art. 6701d, ? 51(a), the trial judge imposed the maximum punishment of thirty days in the county jail and a $200 fine. Id. ? 51(b). Upon direct appeal, the Fourteenth Court of Appeals affirmed. Bartholomew v. State, 834 S.W.2d 475 (Tex. App.--Houston [14th Dist.] 1992). We granted appellants petition for discretionary review to determine whether the Court of Appeals erred in holding that speeding and racing were not lesser included offenses of reckless driving. We will reverse the judgment of the Court of Appeals.
