By information filed in the district court of Kit Carson county, Leonard Brown, to whom we shall hereafter refer as the defendant, was charged with statutory rape allegedly committed July 16, 1948, upon the person of a sixteen year old girl. The defendant entered a plea of not guilty and upon the trial of the cause the jury returned a verdict of guilty as charged. Upon denial of defendants motion for a new trial judgment was entered on the verdict and defendant was sentenced to serve not less than three years nor more than five years in the state penitentiary.
